Switching and export schedule
Schedule to the AGB and free portal terms. It applies to the portal as a data processing service and to the company area for customer ↔ Fesity collaboration, including free use. Customer solutions run in the customer’s accounts. If Fesity exceptionally operates a customer solution itself, the quotation governs its export and switching.
1. Customer choices and initiation
Customers may switch to another provider, transfer to their own infrastructure or choose deletion without switching. Notice in text form to the provider is sufficient. No additional switching notice period applies to the free portal. A service-specific period for separately paid services is agreed in the quotation, subject to statutory maximum periods. We confirm receipt, affected services, contacts and the timetable, and agree a secure export channel. Simultaneous use of multiple providers and statutory unbundling rights are not excluded.
2. Exportable data and digital assets
For the portal agreement, export includes all customer-associated data supplied by the customer or generated by its use within the following categories. Categories without data are marked empty. New categories are added before use.
| Category | Scope and format |
|---|---|
| Company area and team | Master data, profiles, memberships, roles and invitation status; structured JSON/CSV |
| Projects and workflows | Descriptions, status, steps, agreed results and customer-visible reports; JSON and Markdown/PDF |
| Documents and inputs | Uploaded documents, images, audio not yet deleted, texts, transcripts and available revisions; original files with JSON metadata |
| Communication and tasks | Customer-visible messages, threads, tasks, questions, appointments and feedback with timestamps; JSON/CSV, original attachments |
| Offers and delivery approvals | Customer-related offers, pricing/usage records, approved versions, decisions and reasons; JSON/CSV and existing PDFs |
| Contractual evidence | Accepted AGB, portal terms and DPA versions and schedules, acceptance timestamp, existing DPA PDF and checksum |
| Previews and customer results | Customer-assigned approved preview content and contractually promised digital work products; JSON, original media, agreed source code and documentation formats |
| Traceability | Customer-related event, version and reference data required to use exported data; JSON/CSV with a data description |
Agent approvals, autonomy levels and action logs belong to the customer solution operated in the customer’s accounts. If Fesity exceptionally operates a customer solution itself, the quotation governs its export and switching. This distinction cannot retrospectively exclude exportable data actually generated in the portal.
3. Permitted exclusions and interfaces
Excluded are other customers’ data, other individuals’ personal data without a legal basis for disclosure, access codes/active session tokens, security secrets and internal business data unrelated to the customer. Provider/third-party intellectual property or trade secrets may be excluded only as legally permitted; exclusions must not impede switching. Rights in customer work products follow the quotation. Necessary usage data is segregated or protected where appropriate rather than withheld in its entirety.
Before deletion, we provide in particular projects, workflows and documents as files, including available original files. Exports contain a file inventory, reference keys, format descriptions and integrity information. Provision and availability for retrieval are evidenced. Existing downloads and APIs may be used; Fesity supplies a complete assisted export for categories not available through self-service. The export is a snapshot at the time of retrieval; externally embedded videos remain references; data already deleted is not restored. Proprietary formats are converted to commonly used machine-readable formats to the extent legally required. Compatibility with a particular target application requires express agreement.
4. Transition, assistance and continuity
The normal transition period is no more than 30 calendar days after the notice period. We provide reasonable assistance, cooperate in good faith with the customer and its designated receiving provider, maintain agreed services throughout transition and safeguard data. Known interruption risks, dependencies and required customer cooperation are disclosed before transition; avoidable interruptions are prevented. A security issue may restrict a particular transfer channel; a secure alternative must remain available.
If the normal transition is technically impossible, we explain the reasons within 14 working days of the switching request and specify an alternative transition period of no more than seven months. Continuity is maintained during that period. Customers may extend the transition period once for an appropriate period. Further mandatory rights remain unaffected.
5. Contract end, retrieval and deletion
The free portal account can be terminated at any time in text form. Any necessary secure export and retrieval phase is coordinated without creating a new minimum term or payment obligation. The affected contract ends following successful switching; we confirm termination. If deletion without switching is chosen, the free account ends on the requested date; other services follow their validly agreed notice period. Separate contracts end only under their own terms. A retrieval period of at least 30 calendar days follows transition for exportable data and digital assets. Following its expiry, those data are deleted provided switching was successful; a different deletion choice is implemented in accordance with the law and coordinated with the DPA. Deletion must not frustrate lawful retrieval.
Our own records required by law or for specifically justified legal claims remain purpose-limited with restricted access under the retention schedule. Backups are removed under the backup and deletion rules described in the DPA/privacy schedule and are not returned to operational use.
6. Charges and advance information
No switching charges apply to the free portal. For other services, no switching charges are levied from 12 January 2027. Before then, only directly incurred switching costs may be charged within statutory limits if transparently disclosed and agreed before conclusion; this schedule contains no paid switching offer. Disproportionate charges must not frustrate mandatory assistance. Other lawful contractual charges and any consequences of early termination are separately explained in the specific quotation, not disguised as switching charges.
Available export procedures, formats and technical restrictions are made accessible before conclusion. Reliance on Article 31 Data Act requires advance explanation of the specific exception and its limited scope; an ongoing free service is not a time-limited trial merely because it is free.
